The Objective of the Privacy and Security Policy
Garbags seeks to follow the best practices in this field of personal data protection and security, promoting actions and improving systems to safeguard the protection of the data provided to us by our Clients and users in strict respect for and compliance with EU legislation.
The use and navigation on our websites, products and services, filling in our forms and providing data directly or indirectly, implies that the user is aware of and accepts the terms of this privacy and security policy, of the Terms, Policies and Conditions of General Use and other terms, policies and specific conditions of the subscribed services. When subscribing to our services, read the respective terms and conditions carefully. By providing your personal data, you consent to its collection, processing, use and disclosure in accordance with these rules. If you do not agree with this policy, we politely suggest that you do not access or use our Services or interact with any other aspect of our business.
What does it cover?
This policy applies solely to the collection, processing, use and disclosure of personal or navigation data by Garbags under the scope of its digital presence.
Personal information we collection — Personal data, what is it?
Personal data is any information that can be used to discover your identity. This type of information can be for example, your name, mailing address, email address, or telephone number. By using cookies, not directly related to your identity, information can be collected, e.g. how you use Garbags eCommerce Store, can also be personal data. The Services also include our customer support, where you may choose to submit information regarding a problem that you may be experiencing with a Service. Whether you speak to one of our representatives directly or otherwise engage with our support team by email, you will be asked to provide contact information, a summary of the problem you have and any other related information that would be helpful in resolving the issue.
» Personal information we collect automatically when you use our Services or register for an account with us. This information could include the following: Device ID or unique identifier, device type, ID for advertising and a unique device token. We collect certain payment and billing information when you make a purchase order, to enable us to charge you once the checkout is confirmed. You might also provide payment information, such as payment card details, which we collect via secure payment processing services.
» Personal information collected from other sources, such as Social Media. By associating an account managed by a social media site with your account and authorising us to have access to this information, you agree that we can collect, use and retain the information provided by these social media sites in accordance with this privacy notice.
Who is responsible for processing the data?
The entity responsible for collecting and processing personal data is Garbags providing the service and which, in the specific context decides, always in strict compliance with the Personal Data Protection Law, which data is to be collected, the processing means for that data and the format and purpose for which they are to be used.
We take the protection of your personal data seriously. We have taken technical and organizational steps to ensure that the data protection regulations are observed by ourselves and our service providers.
Garbags may only collect your data by telephone, in writing or through its websites and applications with your consent. As a rule, personal data is collected when the Client subscribes to one of our services, or when making a purchase order, request contact via our websites or our Customer service.
Some personal data is mandatory and in the event of the absence or insufficiency of such data, Garbags may not provide the product or service concerned. In these cases the Client or user will be duly informed of the mandatory requirement for such data in order to continue the process.
The collected personal data is processed by computer and in strict compliance with the Personal Data Protection Law. The data is stored in a specific database created for this purpose.
How do we use the cookies?
We also use “cookies” just as many other websites do. Cookies are small text files that are transferred by a Web page server to your hard drive. In this way, we automatically receive certain data such as IP address, browser used, operating system on your computer and your connection to the Internet.
Cookies cannot be used to run programs or deliver viruses to your computer. With the information contained in cookies, we can simplify navigation and facilitate the correct display of our websites.
In any case, the data we collect may not be shared with third parties without your consent.
How long is your personal data stored for?
How long we keep information we collect about you depends on the type of information, as described in further detail below. After such time, we will either delete or anonymize your information or, if this is not possible (for example, because the information has been stored in backup archives), then we will securely store your information and isolate it from any further use until deletion is possible.
We retain your account information for as long as your account is active and a reasonable period thereafter in case you decide to re-activate the Services. We also retain some of your information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations, and to continue to develop and improve our Services. Where we retain information for Service improvement and development, we take steps to eliminate information that directly identifies you, and we only use the information to uncover collective insights about the use of our Services, not to specifically analyze personal characteristics about you.
If you have elected to receive marketing emails from us, we retain information about your marketing preferences for a reasonable period of time from the date you last expressed interest in our Services, such as when you last opened an email from us or ceased using your account. We retain information derived from cookies and other tracking technologies for a reasonable period of time from the date such information was created.
Right to information and to the correction, deletions and blocking of data
Pursuant to the Personal Data Protection Law, the owner of the data is guaranteed the right of access to their data, as well as the right to update, correct or delete their personal data. This can be done at any time by accessing the personal area of your Garbags Client Account. It is also possible for the data owner to delete their account.
You have the right to request a copy of your information, to object to our use of your information (including for marketing purposes), to request the deletion or restriction of your information, or to request your information in a structured, electronic format.
In some cases, you may ask us to stop accessing, storing, using and otherwise processing your information where you believe we don’t have the appropriate rights to do so. For example, if you believe an account was created for you without your permission or you are no longer an active user, you can request that we delete your account as provided in this policy. Where you gave us permission to use your information for a limited purpose, you can contact us to withdraw that consent, but this will not affect any processing that has already taken place at the time.
Credit card data security
Garbags is aware that sending personal information is a major concern for Clients using the Internet. We request your credit card data only if you wish to make a payment of a Garbags service or product.
Security provided by the application is SSL (secure socket layer) technology, which encodes communications between your computer and the server so that the data cannot be intercepted. We will not disclose your credit card number or bank account number to the merchant you have paid through Garbags, unless you authorize us to do so.
Under what circumstances is there communication of data to third parties?
Third-party service providers who help us to provide our Services, payment processing services, assist us in providing customised advertising, to assist us with the prevention, detection, mitigation, and investigation of potentially illegal acts, violations of our User Agreement, fraud and/or security breaches, bill collection, affiliate and rewards programs, co-branded credit cards and other business operations. Garbags may reveal your personal information when we need to do so to comply with law, or credit card rules and financial institution policies involved in payment validation and processing procedures through third-party payment gateways.
Garbags seeks to ensure that the contracting of these entities complies with the highest guarantees in terms of security and reputation.
Clients’ or users’ data may need to be kept and communicated for use by the competent authorities if Garbags is notified by these entities to provide such data, in strict compliance with Portuguese legislation.
Security measures adopted by Garbags
Several security measures have been adopted. Garbags is concerned with ensuring the protection and security of the personal data provided it, by implementing the best technical and procedural practices and ensuring that compliance with this is mandatory by all those who legally access the data.
Garbags aims with these measures to ensure that the conditions are in place, within its scope, to protect the personal data in its care from any form of unlawful processing.
Accordingly, the forms for collecting personal data on all our websites and applications require browser encrypted sessions, and all the personal data provided us is stored securely in the Garbags systems. Those systems implement the best technical and procedural security practices to protect your personal data. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we take into account the sensitivity of the Personal Information we collect, process and store, and the current state of technology to use these measures protect your Personal Information, we cannot guarantee its absolute security. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please contact us immediately.
Notwithstanding the security measures adopted by Garbags, we advise all our Clients and users that when accessing the internet they must take additional security measures, including the use of an updated computer and browser in terms of security, and that they exercise caution when using shared computers. They must also not give their login data to other persons when logging in to their personal accounts.
How can you find out about any changes?
Garbags reserves the right to amend the Privacy, security and data protection policy from time to time at its sole discretion and will provide notice by email or on the homepage of the Site when we make material changes to this Privacy and Security Policy prior to the change becoming effective. If as the result of such changes, you want to alter the ways in which Garbags is allowed to use your Personal Information, you can do so by following the procedure described in the section entitled “Right to information and to the correction, deletion and blocking of data”. We suggest you regularly check it to ensure you remain up-to-date on any changes.
